El memorialista solicitó a la Corte iniciar proceso incidental de desacato, debido a que Colpensiones, en cumplimiento de la sentencia T-164/13, reconoció su prestación pensional aplicando la Ley 33 de 1985 y no la Ley 71 de 1988, tal como lo señaló el precitado fallo.
La Sala decide no asumir el incidente de desacato y en su lugar, remitir la petición a la Corte Suprema de Justicia, Sala Laboral, para que, en su condición de juez competente, la resuelva.

- PRIMERO. NO ASUMIR el estudio de la solicitud de incidente de desacato de la Sentencia T-164 de 2013, promovido por el senor Grigelio Rodriguez Gomez.
- SEGUNDO. REMITIR por Secretaria General de esta Corporacion las presentes diligencias a la Sala de Casacion Laboral de la Corte Suprema de Justicia para que, en su condicion de juez competente, resuelva la mencionada solicitud, teniendo en cuenta las consideraciones contenidas en la parte motiva de esta auto.
- TERCERO. INFORMAR al senor Grigelio Rodriguez Gomez lo resuelto en esta providencia, anexandole copia de la misma.
